Terms of Service

These Terms of Service ("Terms") govern your access to and use of the software services ("Services") provided by PlenDesk ("we", "us"), a Swiss sole proprietorship registered at Lindachstrasse 13, 3038 Kirchlindach BE, Switzerland. The Services currently consist of myID, a SaaS product for privacy-first QR tags and lost-and-found item recovery.
By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. The Services
myID lets you create QR tags for belongings so finders can contact you through a private finder page without seeing your phone number or email address. Users create, download, and print their own QR codes; PlenDesk does not sell or ship physical goods.
We may add, remove, or change features over time. Where a change materially reduces the Services you have paid for, we will give you reasonable notice and a refund where appropriate.
2. Your account
You need an account to use the Services. Authentication is provided through Clerk. You are responsible for keeping your credentials secure and for all activity under your account. Notify us immediately at privacy@plendesk.com if you suspect unauthorised access.
You must be at least 16 years old to use the Services. If you create an account on behalf of an organisation, you confirm that you are authorised to bind that organisation to these Terms.
3. Acceptable use
You agree not to:
- Use the Services to send unsolicited messages, spam, harassment, or any content that is illegal under Swiss or your local law;
- Use myID tags, finder pages, or anonymous chat to impersonate another person, track people without consent, publish illegal content, or disclose personal data you are not allowed to share;
- Reverse engineer, decompile, or attempt to extract the source code of the Services;
- Probe, scan, or otherwise test the security of the Services without our prior written permission;
- Use the Services in any way that could damage, disable, or impair them, or interfere with any other party's use.
We may suspend or terminate your account if you violate these rules. Severe or repeated violations may also be reported to law enforcement.
4. Subscriptions, payments, and refunds
During the current launch review, PlenDesk does not sell or ship physical goods and paid checkout may be unavailable until our payment provider has approved the store. Paid plans and add-ons are intended to be sold as digital SaaS access through the payment provider shown at checkout. When a Merchant of Record checkout is used, that provider is the contractual seller of the purchase and handles payment processing, tax collection, invoicing, chargebacks, and the technical refund process.
PlenDesk is currently preparing Polar as its intended Merchant of Record. If Polar processes your purchase, Polar's terms apply to the payment: Polar's Master Services Terms and Checkout Buyer Terms. We do not store credit card data. See also our Refund Policy for a step-by-step guide.

5. Service availability — no warranty
We provide the Services on a best-effort basis. While we monitor uptime continuously and aim for high availability, we do notguarantee any specific service level, uptime, or response time. The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including (but not limited to) implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Critical reliance disclaimer: myID helps people contact you when they find a tagged item. It does not guarantee that an item will be found, returned, or handled safely, and it is not a substitute for insurance, police reports, emergency services, or any safety-critical tracking system.
6. Limitation of liability
To the maximum extent permitted by Swiss law, PlenDesk's total liability arising out of or in connection with these Terms or your use of the Services is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim, or CHF 100, whichever is greater.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages. This limitation does not apply where prohibited by mandatory law (notably, gross negligence or wilful misconduct under Swiss law).
7. Termination
You may terminate your account at any time by deleting it through your Clerk account settings. Upon deletion, your personal data is cascaded out of our systems automatically (see our Privacy Policy). Active paid subscriptions remain billed until the end of the current billing period unless cancelled separately through the payment provider shown at checkout.
We may suspend or terminate your access to the Services if you materially breach these Terms, with notice where practical.
8. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. Material changes will be communicated through the Services or by email. Continued use after a change constitutes acceptance.
9. Governing law and jurisdiction
These Terms are governed by Swiss law, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG). Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Kirchlindach, Switzerland, subject to mandatory consumer-protection venues that may apply in your jurisdiction.
